One way in which Isolation is presented in through social isolation: it can be noted that Piggy is particularly a victim here. Golding states that the â€Å"naked crooks of [Piggy’s] knees were plump and that he was â€Å"shorter than the fair boy†. From Piggy’s immediate introduction, he is already portrayed as an outsider, in comparison with the â€Å"fair boy† who symbolises the other islanders. Perhaps Golding’s use of the word â€Å"naked† is an implicit way of suggesting Piggy’s vulnerability which is what ultimately leads to Piggy being socially isolated. An interesting instance of Piggy as a victim of social isolation is when he is forbidden to sit with the rest of the islanders; â€Å"Piggy sat expressionless behind the luminous wall of his myopia†- Golding is explicitly stating that Piggy is excluded because of his â€Å"myopia†, which is compared to a wall; the â€Å"luminous wall† represents a metaphorical wall between Piggy and the rest of society. Piggy himself appears to accept that he is not accepted by referring to the islanders as â€Å"them other kids†; the word â€Å"them† highlights this clear difference in social status between Piggy and the other islanders and hence why he is excluded. One could argue that Golding is utilising social isolation to criticise British culture; as many were a victim of social prejudice when this book was published in the 1950s. This is comparable to the social isolation faced by Kingshaw in I’m the King of the Castle; which, like Piggy’s, is caused by Kingshaw being a member of the lower class. Hill immediately indicates Kingshaw lower class, upon his introduction describing the sky as â€Å"the colour of dirty sixpences† – I feel this is interesting on two notes, perhaps the six pence is an indication of Kinghaw’s lower class because a sixpence was of little value, or equally the â€Å"dirty colours† could be a form of pathetic fallacy, and hence a form of prolepsis beckoning for Kingshaw to suffer social isolation. One example of the social isolation faced by Kingshaw is when he escapes from Waring’s to the remote Hang Wood, which is depicted (from Kingshaw’s point of view) as â€Å"being completely hidden† and thus why â€Å"he liked it†. The word hidden is comparable to isolation, something that Kingshaw could only dream about. Hill, like Golding, may also be criticising the divide in classes, perhaps she felt that the lower class were often mis-treated, the effects of which burdened on the youngest of the family. Both Piggy and Kingshaw are comparable because they face social isolation because they are of lower class. However, it should be noted that whilst Piggy does not wish to subjected to isolation, Kingshaw see isolation as method of escaping persecution, and therefore he embraces isolation. Because of this, I feel Hill has been the more effective author in here use of isolation, isolation has a greater meaning in I’m the King of the Castle, it is Kinghaw’s only method of surviving Hooper’s reign of terror, whereas in Lord of the Flies, the reader can argue Golding’s portrayal of Piggy as an irritating character is also a cause of his isolation. An issue both authors face however is that their ideas on class are now out-dated, the modern reader may not understand references made by Hill and Golding regarding class. Another way that Golding utilises isolation, is in the portrayal and hence the effects of the isolation of children from adults. When the children discover there aren’t any adults on the island, they begin to distribute â€Å"adult† roles in society, and begin creating their own rules. Initially Piggy appears to be horrified at the prospect of isolation from adults; nervously asking â€Å"Aren’t there any grown ups at all?†- Piggy the voice of reason is aware of the ill-effects of children inhabiting an island by themselves, and most likely explains the cause of concern in his voice. This isolation from â€Å"grow-ups† has devastating effects, as the children begin to lose contact with the rules that the very adults made themselves: this is symbolised when the savages are â€Å"painted out of recognition†- in this case recognition could symbolically represent the rules of society (adults) but because of the isolation faced by the savages, the y no longer obey such rules. The verb â€Å"painted† is especially effective here as it describes the manner in which isolation affects the young: slowly over time. Another instance of isolation causing behaviour that our society would not accept is when a dictatorship emerges under Jack: one of the highlights of this being when a savage states â€Å"[Jack] is going to beat Wilfred† – the casual manner in which the savage speaks depicts the distances that Jack’s â€Å"tribe† have moved from society, there is no emotion in that phrase and this only further suggests the negative impact on children when they are isolated from adults. Perhaps Golding is being cynical of human nature, criticising humans and their lack of empathy which only appears to be existent because of the rules of society. Maybe, Golding see’s the deeper impacts of bad human nature, such as poverty in poorer countries.

Doctrine of Frustration Essay

ACCORDING to Section 56, an agreement to do an act impossible in itself is void (for example, an agreement to discover treasure by magic). Supervening impossibility or illegality refers to the intrusion or occurrence of an unexpected event or change of circumstances beyond the contemplation of the parties; such event or change of circumstances must be so fundamental as to be regarded by law as striking at the root of contract as a whole or the basis of the contract no longer exists. Subsequent impossibility in the UK is referred to as Doctrine of Frustration. A contract is deemed to have become impossible of performance and, thus, void under the following circumstances: a) Destruction of the subject matter of the contract; b) By death or permanent incapacity of the parties (like insanity) where the contract is personal in nature; c) Supervening impossibility or illegality, involving actions contrary to law or public policy; d) Outbreak of war, war restrictions (avoidance of trading with alien enemy, and so on); e) Imposition of government restriction or orders or acquisition by government; and f) Non-existence or non-occurrence of a particular state of things. Apart from the above circumstances, impossibility does not discharge a person from the contract. He who agrees to do an act should do it unless impossibility arises in any of the ways mentioned above. . FRUSTRATION – MEANING, SCOPE AND APPLICABILITY Section 56 of the Indian Contract Act, 1872 stipulates: â€Å"Agreement to do impossible act: An agreement to do an act impossible in itself is void. Contract to do act afterwards becoming impossible or unlawful: A contract to do an act which, after the contract is made, becomes impossible, or, by reason of some event which the promisor could not prevent, unlawful, becomes void when the act becomes impossible or unlawful. Compensation for loss through non-performance of act known to be impossible or unlawful: Where one person has promised to do something which he knew, or, with reasonable diligence, might have known, and which the promisee did not know, to be impossible or unlawful, such promisor must make compensation to such promisee for any loss which such promisee sustains through the non-performance of the promise.† Frustration may be defined as the occurrence of an intervening event or change of circumstances so fundamental as to be regarded by the law both striking at the root of the agreement, and as entirely beyond what was contemplated by the parties when they entered into the agreement. If an event which could not be foreseen by both parties supervenes, frustration would apply. Section 56 of the Indian Contract Act, 1872 does not deal with the cases in which an event, the parties took it for granted will never happen does happen and makes the performance of the contract impossible. If it be held that this Section is exhaustive, no relief can be granted to any of the parties on the happening of such an event, but this would be against the very principle underlying the Section. (16) If the inability to perform the contract is due to the fault of one of the parties, he cannot successfully plead frustration. It is also true that if the parties expressly contract with reference to the occurrence of the supervening events, frustration is inapplicable. But there is another type of case outside these rules. The parties when they made the contract, may have foreseen the supervening event as probable, but may have made no express provision with respect to it. Here, if such event occurs, frustration can be pleaded. (17) LORD RADCLIFF has succinctly summarized the law relating to frustration of contracts as under: â€Å"†¦.frustration occurs whenever the law recognizes that without default of either party, a contractual obligation has become inapplicable of being performed because the circumstances in which the performance is called for would render it a thing radically different from that which was undertaken by the contract.’†¦.It was not this that I promised to do.’ There is, however, no uncertainty as to the materials upon which the Court must proceed. ‘The data for decision, on the one hand, the terms and conditions of the contract, read in the light of the then circumstances and, on the other hand, the events which have occurred.’ In the nature of thing there is often no need for any elaborate enquiry. The Court must act upon a general impression of what its rule requires. It is for that reason that special importance is necessarily attached to the occurrence of an unexpected event that, as it were, changes the face of the things. But even so, it is not hardship or inconvenience or material loss itself which calls the principle of frustration into play.†(18) IMPOSSIBILITY OF PERFORMANCE AMOUNTS TO FRUSTRATION A man can be expected to do what is humanly possible but he cannot be expected morally or legally to do what is not physically possible. It cannot be disputed that when a thing is beyond the human control it cannot be expected from the party which had undertaken to do the work to suffer the consequences of not proceeding with the contract work and in such a situation both the parties are relieved from their contractual responsibilities. The word â€Å"impossible† in Section 56 of the Indian Contract Act, 1872 has not been used in the sense of physical or literal impossibility. The performance of an act may not be literally impossible, but it may be impracticable and unless from the point of view of the object and which the parties had in view; and if an untoward event or change of circumstances totally upsets the very foundation upon which the parties rested their bargain, it can very well be said that the promisor finds it impossible to do the act which he promised to do. (21) If the performance of a contract becomes impracticable or useless having regard to the object and purpose the parties had in view then it must be held that the performance of the contract has become impossible. But the supervening event should take away the basis of the contract and it should be of such a character that it strikes at the root of the contract. (22) The essential principles on which the doctrine of frustration is based on the impossibility, or, rather, the impracticability in law or fact of the performance of a contract brought about by an unforeseen or unforeseeable sweeping change in the circumstances intervening after the contract was made. In other words, while the contract was properly entered into in the context of certain circumstances which existed at the time it fell to be made, the situation becomes so radically changed subsequently that the very foundation which subsisted underneath the contract as it were gets shaken, nay, the change of circumstances is so fundamental that it strikes at the very root of the contract, then the principle of frustration steps in and the parties are excused from or relieved of the responsibility of performing the contract which otherwise lay upon them.(23) HAPPENING OF UNPRECEDENTED EVENTS CAUSES FRUSTRATION To attract the plea of frustration, it must be shown that the situation has changed so drastically and so radically that neither party to the contract could have at all foreseen that because of something happening at another place which may be a foreign country would result in execution of the contract almost as good as an impossibility. The impact which the market receives due to an event happening elsewhere in the guiding factor for determining whether or not frustration has occurred. Where after the firm price contract for supply of transformers there was a subsequent 400% rise in price of transformer oil due to the war, there was frustration of contract. The abnormal increase in price due to war condition was an untoward event or change of circumstances which â€Å"totally upset the very foundation upon which the parties rested their bargain.† Therefore, supplier could be said to be finding itself impossible to supply the transformers which it promised to do. (25) The parties to an executory contract are often faced, in the course of carrying it out, with a turn of event which they did not at all anticipate – a wholly abnormal rise or fall in prices, a sudden depreciation of currency, an unexpected obstacle to execution, or the like. Though a Genet character exists in Genet's other novels, this information appears only in Journal du voleur. What is most remarkable about this fact is that, rather than stabilizing the identity of the author, by its very nature it destabilizes. The fact that Genet was orphaned at a young age, and that he knows only the name of his mother, and not that of his father, puts the author character in an awkward posi tion in a society more patrilineal than most. The Journal is in many ways, an aesthetic treatise, an examination of the ideas and practices that have made Genet a creator. The two fundamental concepts that drive his creation are "beauty," and a vertiginous space that we could call the "vide," or, "nothingness." His writing exists in a tense space between the aesthetic attractions of the physical world, and the intellectual imperative of the contemplation of the emptiness of existence. Genet attributes his attraction to the physical world to its beauty. Pinning down a precise meaning of beauty is difficult. In the short entry on "beauty" in the Oxford Companion to Philosophy, Aquinas is quoted as defining beauty as "that which pleases in the very apprehension of it" (80). This definition, though vague, does point to two components of the assessment of beauty, the observer and the observed. There is no beauty without a subjectivity to apprehend it. The article goes on to note that the physical beauty of a human being is hard to define in the absence of the desire that is aroused by that person in the beholder. Though philosophers have long searched to provide an understanding of the universality of beauty, we must ask if any assessment of beauty can be truly objective. It would seem that, in order for aesthetic judgements such as beauty to be meaningful, they would have to be understood in the context of subjectivity. Aesthetic philosophy, beginning with Longinus, has chosen to focus on the "sublime," that which transcends mere physical beauty and creates a deeper, more mystical meaning. In his treatise On the Sublime, Longinus says, "sublimity in all its truth and beauty exists in such works as please all men at all times" (107). In nursing ethics play a critical role, breaching confidentiality can have a magnitude of ethical consequences including legal issues and patients no longer trusting medical professionals. As healthcare professionals, we are faced with situations daily with an array of ethical, legal and professional responsibilities where we have to use our own personal judgments to protect both our patients but the public as well. As a legal concept, confidentiality can be said to be an obligation on one person to uphold the privacy and security of another person’s information. This legal obligation arises in several areas: under common law; in contract law where these terms can be express terms or implied; and as a general legal duty where it could be considered negligent if harm results as a consequence of a breach of confidence. † (Cornock 2011). Confidentiality does not override ethical principles in all cases, and some cases it would be considered unethical to not break confidentiality when a legal requirement makes a breach mandatory. By breaching patients confidentiality breaks the trust that was built between patient and provider. â€Å"Utilitarianism, an act is right if it helps to bring about the best balance of benefits over burdens, in other words, the best â€Å"utility† or consequences overall. (Purtilo 92) This theory would be basing a decision on whether or not the action (breaking or not breaking confidentiality) brings out the best outcome. However, sometimes the best outcome isn’t legally correct. In the article â€Å"Bioethics on NBC’s ER: Betraying Trust or Providing Good care? When is it ok to Break Confidentiality? by Pamela Nathanson, we see a time when a healthcare provider is faced with an ethical dilemma on whether to break a patient’s confidentiality in order to protect the patient and the community. Like with any ethical dilemma there are steps that can be used to help a healthcare provider make a decision or help solve the problem. These steps include: 1) gather relevant information, 2) identify the type of ethical problem, 3) use ethics theories or approaches to analyze the problem(s), 4) explore the practical alternatives, 5) complete the action, and finally 6) evaluate the process and outcome. (Purtilo pg 102-110) Using this process healthcare professionals are able to make decisions to tough ethical dilemmas that come up in their clinical practice. I agree with Ms. Nathanson that the parents needed to be informed of their daughters diagnosis in order to prevent harm to the patient and ensuring the patient receives proper follow up care. I also agree that the school did not need to be informed of who the student was but to inform the school that it had come to the attention of medical professionals about sex parties going on in the school. By choosing this way you are ensuring the safety of your patient and the community with causing the least amount of damage. If you disclosed to the school who the student was as the nurse did in the show you risk unnecessary harm to your patient. Ethics committees are made up of members that include a lawyer, an ethicist, quality improvement manager, a nurse, a clergyman, a physician and an individual from within the community. By joining together these members with diverse backgrounds, experiences and perspectives they are able to come together to help develop different alternatives and discussions regarding ethical dilemmas that may arise. They are able to help provide recommendations in complex and challenging ethical situations. However, these decisions are not law but they do hold certain significance on influencing a judge or jury. (GCU) As long as health care deals with life and death, ethical dilemmas will come into play for medical professionals everywhere on a daily basis. Due to the nature of the medical profession, complex situations will require fast acting decisions that can be life changing for all parties involved. The focus of current study is to understand the affect of Training and Development, On the Job Training, Training Design and Delivery style on Organizational performance. The back bone of this study is the secondary data comprised of comprehensive literature review. Four Hypotheses are developed to see the Impact of all the independent variables on the overall Organizational Performance. The Hypotheses show that all these have significant affect on Organizational Performance. These Hypotheses came from the literature review and we have also proved them with the help of literature review. Results show that Training and Development, On the Job Training, Training Design and Delivery style have significant affect on Organizational Performance and all these have positively affect the Organizational Performance. It means it increases the overal l organizational performance. We also prove our Hypothesis through empirical data. However, results are strongly based on the literature review. INTRODUCTION Training has the distinct role in the achievement of an organizational goal by incorporating the Interests of organization and the workforce. It seems that Training design plays a very vital role in the employee as well as organizational per formance. A bad training design is nothing but the loss of time and money. On the job training helps employees to get the knowledge of their job in a better way. It is cost effective and time saving. It is good for organization to give their employees on the job training so that their employees learnt in a practical way. Delivery style is a very important part of Training and Development. Employees are very conscious about the delivery style. If someone is not delivering the training in an impressive style and he is not capturing the attention of the audience it is means he is wasting the time. It is very necessary for a trainer to engage its audience during the training sess. Delivery style means so much in the Training and Development. It is very difficult for an employee to perform well at the job place without any pre-training. Trained employees perform well as compared to untrained employees. It is very necessary for any organization to give its employees training to get overall goals of the organization in a better way. Training and development increase the overall performance of the organization. Although it is costly to give training to the employees but in the long run it give back more than it took. Every organization should develop its employees according to the need of that time so that they could compete with their competitors. LITERATURE REVIEW Human resource is the very important and the People learn from their practical experience much better as compare to bookish knowledge. It is better for the organizations to give their employees on the job training because it is employees development and the employee development encourage self-fulfilling skills and abilities of employee, decreased operational costs, limits organizational liabilities and changing goals objectives THEORETICAL FRAMEWORK To implement the study following dependent and independent variables are shown in the theoretical HYPOTHESIS DEVELOPMENT Hypothesis development is very important because acceptance and the rejection of hypothesis show the significance of the study. On the basis of literature review and above theoretical frame work we came to develop following hypothesis. In the training development organizational performance is also affected by the training design. Therefore our first hypothesis is: H1: Training design has significant effect on the organizational performance. To increase the knowledge and skills in the job training is given to the employees therefore our second hypothesis is: H2: On the job training has significant effect on the organizational performance. During training development the delivery style of the person who is giving the training also affects the organizational performance so our third hypothesis is: H3: Delivery style has significant effect on the organizational performance. By combining the above mentioned hypothesis our fourth hypothesis is: H4: Training development has significant effect on the organizational performance. METHODOLOGY The study sample comprised of 100 employees of different organizations of Islamabad, capital of Pakistan. The sample is mixed like both male and female. The data is collected through a questionnaire consists of 15 questions. All questions are close ended questions with the use of a five point Likert scale consisted of strongly disagree, disagree, neutral, agree and strongly agree. All questionnaires were distributed and collected by hand from the offices of the organizations in the office timings. Ninety five questionnaires were collected after one weak. 95 of them gave the response to our questionnaire. After checking them 79 were found correct and the respond rate was 83%. These 79 questionnaires were included in the study. The analysis of the questionnaire was undertaken using Statistical Package for Social Sciences (SPSS). All mean and medians were calculated using SPSS. Descriptive statistics was used to determine the independent variables and to conclude the results on the basis of secondary and primary data. Most of the results consist of secondary data. DISCUSSION It is very necessary for the organization to design the training very carefully. The design of the training should be according to the needs of the employees. Those organizations which develop a good training design according to the need of the employees as well as to the organization always get good results. It will help them to understand that it is very necessary for them to give training to their employees so that they could perform the assign task in a better way. RECOMMENDATIONS In this research we review a lot of materials related to the variables used in this research and at the end we also proved our hypotheses. In the light of all this research and all the material which is being used to conduct this research and all the literature review we came to the decision that there should be Training and Development in every organization. Although we have review some disadvantages like it is costly to give training to the employees, but the advantages of Training are much more than its disadvantages which are briefly discussed in this study. We recommend that all organizations should provide Training their employees. We already have discussed that Training and Development have advantages not only for employee but the ultimate benefit is for the organization itself. If the performance of the employee is not good it will affect the whole organization. CONCLUSION Training and Development has positive effect on Organizational Performance. Discussion of all the results proves the hypotheses; H1: Training design has significant effect on the organizational performance, H2: On the job training has significant effect on the organizational performance, H3: Delivery style has significant effect on the organizational performance and H4: Training development has significant effect on the organizational performance. All these have positive effects on the Organizational Performance. It improves the Organizational Performance. On the Job Training is very effective and it also saves time and cost. Training and Development, On the Job Training, Training Design and Delivery style have significant effect on Organizational Performance and all these have positively affect the Organizational Performance. It means it increases the overall organizational performance. FUTURE STUDY Primary data is not collected; the study only depends on secondary data. Study can be conduct on different departments of the organizations that which department needs more training and development. Mandatory Public School Uniforms are a Good Thing Essay -- dress code,

Nowadays, we see many teenagers dress in spaghetti-strap tank tops, low-cut shirts, drop pants, pajamas, and even spandex shorts in school even though there have been policies about dress codes. Teachers, parents, and other adults feel disgruntled about the way they dress. Many students also complain about difficulties in concentrating on schoolwork because of the same reason. Obviously, what students wear to school has become a very distracting issue in the school environment. Therefore, school uniforms should be required in public schools due to many reasons. There have been many forums and discussions about mandatory school uniforms in public schools. They assume that wearing uniforms is a kind of Nazi education tactic; however, school uniforms reduce fashion-envy among students. For example, it is extremely easy to tell who is rich and popular at a public high school. Only popular girls wear Buckle Jeans that cost approximately one hundred dollars per pair. Only popular boys wore Ralph Lauren T-shirts to school. High school students are teenagers who are developing their self-esteem; therefore, it is important to guide students to lead a confident life without caring too much about appearance and materialistic things. The Humour in Educating Rita ‘Educating Rita’ is a humorous play that was written by Willy Russell in 1979, based on his own life. It is set in Liverpool and depicts the perseverance of a working class, 26-year-old hairdresser with no qualifications called Susan, or as she is called throughout the play, ‘Rita’, as she tries to ‘discover herself’ by participating in an English literature course at the Open University. Her lecturer, who is from a more middle class background, Frank, is somewhat of an unorthodox one; he is frequently found to be drunk and, during one lecture, he is so drunk that he falls off of the rostrum in the hall! This erratic behaviour leads to him being sent to Australia for two years. In this essay, I am going to discuss how I might direct this play so that I achieve humour for the audience. There are four main aspects that create the humour in the play ‘Educating Rita’: the first of which is the comedy of the character. This is when a character in the play is perceived as being humorous by the way that the character speaks or a trait that the character has. When Rita enters Frank’s classroom in the first scene, she blurts out: â€Å"I’m coming in, aren’t I? It’s that stupid bleedin’ handle on the door. You wanna get it fixed!† As director, I would have the actress playing Rita fall through the door and point towards Frank, as if to order him to fix the door. The actor playing Frank would have to put on a stern face, looking in disbelief at Rita; in shock at the way she entered. Considering the fact that this is an interview situation, the audience would be shocked, as the language is totally out of the blue and inappropriate for such a formal situation. Also the fact that she ... ...e rostrum- an action that occurs because of his drunkenness. Along with Frank’s drinking, Rita’s entrance to the play is an example of extremely effective comedy of character. However, as the play progresses and Rita becomes more aware and cognisant of her actions the comedy seems to derive from Frank’s drunkenness. There is much to be said as to how you would direct this play. Personally I would involve more than just the two characters Frank and Rita. This would give me as director, the chance to introduce more humorous situations. Other occurrences that would possibly make the play more interesting could be added to the play with the introduction of extra characters. Willy Russell wrote this play to be performed, but I must wonder why he wrote the play with only two characters if he did eventually see the play being performed on the silver screen.
